The recent changes in Portuguese waste legislation, in particular through Decree-Lei n.º 24/2024 of March 26, 2024, will have a future impact on companies that place packaging, furniture, mattresses and self-care products on the market in the domestic environment. These amendments extend the Extended Producer Responsibility (EPR) and introduce new obligations that companies must integrate into their compliance strategies.

1. Expansion of EPR to include furniture, mattresses and products for self-care home aplliances

Extended producer responsibility will be extended to additional product categories, including furniture, mattresses and certain products for self-care home aplliances. Manufacturers and importers of these products must ensure their collection, recycling and environmentally sound disposal.

 

  • Implementation deadline: 
    This extension will take effect from December 31, 2025.

2. Management of non-reusable industrial packaging

Companies that place non-reusable industrial packaging on the market are now obliged to implement specific measures for the collection and recycling of this packaging. This includes setting up take-back systems and ensuring environmentally sound disposal.

 

  • Implementation deadline: 
    These obligations will come into force on January 01, 2025.

3. Reporting Obligation for Reusable Packaging

Companies are obliged to submit detailed annual reports on the quantity and type of reusable packaging placed on the market. These reports must contain information on the service life of the packaging and the return rates.

 

  • Implementation deadline: 
    The annual reporting obligation came into force on March 27, 2024.

4. Labeling of Reusable Packaging

Reusable packaging must be clearly labeled to indicate its reusability and correct handling. This labeling is intended to promote return and recycling.

 

  • Implementation deadline: 
    The labeling requirement is to come into force one year after its publication on the APA authority website, tba.

5. Eco-Modulation

The fees for the disposal of packaging are adjusted according to the principle of eco-modulation. This means that more environmentally friendly packaging is charged lower fees, while less sustainable options incur higher costs.

  • Implementation deadline: 
    Eco-modulation will be introduced from January 01, 2026.

These changes require companies to take proactive measures to adapt their processes and products. It is essential to understand and implement the new legal requirements to ensure EPR compliance and avoid potential penalties.
