The French Decree 2022-748, adopted within the framework of the "Anti-Waste for a Circular Economy Law (AGEC)" in France, introduces new requirements regarding recyclability for businesses. But what exactly does this mean for us? Let's clarify this in simple terms.

Start of the new regulations on recyclability in France

The decree came into effect on March 1, 2022. There was a transition period until January 1, 2023. From this date, the requirements for recyclability will gradually become stricter, initially affecting the largest companies (with an annual turnover of 50 million € AND an annual quantity of 25,000, all related to France) and later also SMEs and smaller companies. 

Of particular interest: From January 1, 2024, other specific product categories in France, such as building products, toys, and various motor vehicles, must also comply with the new recyclability regulations.

What are the new requirements for recyclability?

Depending on the industry, there are different recyclability requirements in France: 

  • Electronics:
    Electrical and electronic devices must have a repairability and durability index by 2024.
     
  • Packaging: 
    They must provide information on whether they are compostable and if they can be reused.
     
  • Materials:
    Products must indicate the proportion of recycled material and the use of renewable resources.
     
  • Precious metals & rare earths:
    Electronic devices and vehicles must provide information about the presence of precious metals and rare earths.
     
  • Safety:
    Products containing hazardous substances must clearly indicate this.
     
  • Textiles:
    They must provide information on traceability and the presence of microfibers.
